STORE POLICY: REFUNDS

All sales are final. No cash refunds. Returns are for store credit only. In store credit will be issued at out discretion, only up the amount of $250. Receipts are required for exchanges and/or credits within 30 days of original purchase. No refunds or returns on strings will be made. Due to copyright laws Symphony Strings Music Co. cannot process returns or refunds on ANY music for ANY reason.

 

REPAIR POLICY

Repairs MUST be paid in full in advance before ANY work will be started on any instrument or bow. Symphony Strings Music Co. is NOT responsible for any strings that may break during the normal course of repair, or while tuning. Estimates will be honored for ONLY 10 days after the date of required documentation.

After notice of completion (by phone, text, and/or email) customer will have 3 business days, starting the next business day after initial contact to retrieve property. Starting the 4th day there will be a storage fee of $2 per day will be added to the repair ticket. All payments MUST be made BEFORE Symphony Strings Music Co. will return any property. If after 30 days of initial notice, an additional $25 will automatically be added in advance of the next 15 days. If after 45 days of initial notice, all property will be considered abandoned property and will become property of Symphony Strings Music Co.

UNCLAIMED MERCHANDISE/PROPERTY

Unclaimed items pertain to all items left in store without any documentation under special circumstances including but not limiting insurance appraisals, consignments, repair estimates, and special orders. Unless otherwise documented, all items will be held for customer upon completion of transaction. Customer will be notified (by phone, text, and/or email) and MUST pickup property within 3 business days, starting the next business day after initial contact. PRIVACY POLICY

Customer Information is taken seriously at Symphony Strings Music Co. SSMC will never sell or distribute customer information for marketing purposes. Customer information is protected and kept securely at all times. Information collected will vary upon the purchase within SSMC.

Retail Purchases: Purchases may be made in store, by mail or by telephone. Should customer(s) choose to purchase by credit/debit card, complete card information along with billing address will be collected. All checks collected will require ID, customer address, and contact number.

Instrument Purchases: purchases may be made in cash, check, money order, and credit/debit card. Customer ID, and owner information will be collected with every purchase. SSMC will collect this information to properly distribute and Insurance Appraisal.

Rental Information: All rentals remain property of Symphony Strings Music Co. at all times. Renters are to provide complete name, address, State ID, last four of social security number, valid email address, employer information, references, spouse information, & complete billing information.

Financing Purchases: Application are required to be considered for financing by Synchrony Financial. Applicant should provide, Name, Address, Social Security Number, Phone, Monthly Net Income, & Email Address.  Information is collected to determine credit approval.

 

RENTAL INSTRUMENT TERMS & CONDITIONS

Protection Plans// All plans include a Replacement Instrument Deductible, that will protect the renter in the event of loss, fire, theft or flood with proof of an insurance or police report. If an insurance document or police report can NOT be provided, the renter will be responsible for the full value of the instrument, bow and/or case, listed on page 1. Do not throw ANY items away. Any broken/damaged items MUST be presented to qualify for protection plan coverage. Missing items will NOT be covered by ANY plan, and will be the responsibility of the renter to purchase all missing items from Symphony Strings Music Co. All instruments will be assessed for repair and examination. Standard Protection Plans: if an instruments repairs exceed the cost of the Replacement Instrument Deductible, the renter will pay the lesser of the two amounts. All Protection Plans: if instrument is deemed to be “beyond repair”, or “total loss”, the renter will be responsible for the Replacement Instrument Deductible. Any report submitted MUST collaborate with time frame of active protection plan and account must be current and up to date. Account number MUST be provided for any claim submitted or used under the Protection Plan. Account numbers may be found on the front of renter’s contract.

 

Fee Structure and Statement Payment Policy// Renter agrees to pay Symphony Strings Music Co., 7355 Remcon Cir, Ste 101 El Paso, TX 79912 or any other place designated in writing by Symphony Strings Music Co. the total monthly payment in advance as stated above for each month that the instrument, case and/or bow are provided by Symphony Strings Music Co. for the use of the renter. Renter agrees to maintain the instrument, bow and/or case in “same as” condition and submit instrument, case and/or bow EXCLUSIVELY to Symphony Strings Music Co. for maintenance and repairs as needed under the terms and conditions of the Protection Plans. In the event any item(s) is repaired by a different company or persons not employed by Symphony Strings Music Co., renter may be liable for full retail costs associated with reversing any damage done, and/or responsible for the full value of the instrument, bow and case listed on Page 1 regardless of Protection Plan. Renter may change protection plans at any time provided they fill out a new contract in-store, and upon inspection of the current instrument. Any and all rental repairs and/or replacement items will be at the discretion of Symphony Strings Music Co. and are subject to fees if not approved by Symphony Strings Music Co. There will be a $20 handling fee for checks returned to us unpaid for any reason. Failure to receive a statement does not release renter from responsibility of making timely payments. Renter agrees if this instrument is exchanged for a replacement, the term Instrument shall refer to such replacement instrument as well as any instrument retained by renter together with the case and bow provided. The instrument, bow and case are property of Symphony Strings Music Co. Renter hereby grants Symphony Strings Music Co. the right to recover the instrument case, and/or bow at any place, and time, by any legal means, in the case of nonpayment. PLEASE NOTE: if Protection Plan has lapsed due to non-payment, renter agrees to pay for all maintenance and repair costs during the terms of the rental and/or at the conclusion of the rental agreement according to the usual, and customary charges for the repair at Symphony Strings Music Co.

 

Monthly Payment Information//The Monthly Rental Payment will include the instrument rates, protection plan, and tax, all due monthly. The renter agrees to maintain the credit or debit card open and within credit limits to permit the timely charges for the payments. At all times, there is to be a valid credit card on file. Renter agrees that the most recent valid credit card information will be used towards monthly payment until the renter has replaced card or made another form of payment prior to renter’s due date. It is the renter’s responsibility to make sure that, any and all billing/contact information on rental account be kept up to date throughout the life of the rental. This is to include a valid email, phone numbers, references, and credit/debit card information. Rent MUST be paid for the entire time an instrument is in the renter’s possession, regardless of whether or not the instrument is being used. The first payment, and deposit are due upon initiation of this agreement. No exception will be made. Subsequent payments are due on the date designated on page 1, and have a grace period of 5 days. Starting day 6, a $15 late fee will be added to the past due amount owed. An additional $15 late fee will be added for every 15 days the renter is past due. After 45 days of a delinquent account, the account is subject to loss of trade credit, as well as the potential full value owed for the instrument, case and/or bow listed on page 1. Symphony Strings Music Co. reserves the right to charge the renter the full value of the instrument, case, and/or bow if the account is delinquent 60 days or more. In addition, the renter will be liable for reasonable collection and/or attorney’s fees where this agreement is referred to a collection agent or attorney who is not a salaried employee of Symphony Strings Music Co. and court costs. All maintenance and/or protection plans will be suspended until all charges are paid in full.

Trade Credit//Through the duration of the rental agreement, the renter will be gaining Trade Credit to use towards a future purchase. 100% of the rental rate (not including protection plan, and tax) will be accumulated every month for only up to 18 months. Available Trade Credit may not apply toward more than 50% of an instrument’s price. Any renter that may choose to continue renting after 18 months will not gain any additional trade credit. Trade Credit may be used towards the purchase of a single instrument for purchase only, and will NOT be valid with any other discount or promotion unless stated in writing by Symphony String Music Co. If renter chooses to return their instrument before using their trade credit, their trade credit will only be valid up to 30 days after returning the instrument. If renter elects to not use trade credit before the end of 30 days, the balance of trade credit will be forfeited. Trade credit may NOT be “gifted” to an additional renter or customer without previous authorization from Symphony Strings Music Co. Unused trade credit is not refundable or eligible to receive back in form of cash, credit, or in-store credit other than towards a purchase of an instrument. No exceptions will be made.

Return Policy//Renter may choose to cancel this agreement at any time, provided that all charges are paid in full, by returning the instrument, case and/or bow to Symphony Strings Music Co. to 7355 Remcon Cir, Ste 101 El Paso, TX 79912. Renter agrees to pay any and all shipping costs relating to returns and/or maintenance for the instrument to or from Symphony Strings Music Co. A 30-day written notice is required to receive deposit back. If renter elects to return, without 30-day notice, deposit will be forfeited. Instrument will be inspected upon return. If instrument needs any repairs or strings to be replaced, renter will be responsible for the cost of new string(s) and/or any repairs needed to instrument, case or bow. Renter authorizes Symphony Strings Music Co. to charge the card or account on file for any unpaid repairs relating to their rental instrument. If the rental agreement is not terminated by or before the renter’s due date, the renter must pay full charges for that month. Rental charges will not be prorated for any reason. If rental instrument is returned same business day the payment was processed, renter may be eligible for refund. Renter MUST mention payment refund during return process to an employee of Symphony Strings Music Co. Payments or charges will not be refunded for any instruments that are returned after 24 hours the renter’s payment was processed.

Governing Law//Renter agrees to authorize Symphony Strings Music Co. to obtain a consumer credit report or other information regarding me and to contact my employer and the references listed on page 1. Renter agrees that Texas Law governs the terms of this agreement and that El Paso County is the only place where renter Symphony Strings Music Co. may file any action relating to this agreement. Renter agrees to pay attorney’s fee and costs in any lawsuit relating to this agreement, including appeal. If any provision of this agreement is determined to be invalid, such provision shall be automatically revised to match as closely as possible the intent hereunder while consistent with applicable law and it shall not affect the validity of any other provision.

SYMPHONY STRINGS MUSIC CO. RESERVES THE RIGHT TO CHANGE OR ALTER THESE POLICIES, AT THEIR DISCRETION AS THEY SEE FIT, WITHOUT NOTICE.
